1. YourPianoCover.com digital piano sheets download service
YourPianoCover offers downloads of music arranged for piano (“Digital Content”) and shipment of some physical items (“Physical Content”). YourPianoCover allows you to access and download Digital Content from yourpianocover.com
2. Digital Content and Physical Content
2.1 Rights Granted
2.1.1 Upon your payment of our fees for Digital Content we grant you a non-exclusive, non-transferable, non-sub license-able, limited right and license to download, and to retain a permanent downloaded copy to use the Digital Content for your personal, non-commercial, entertainment use, and private use only subject to and in accordance with the Terms of Use. You may copy, store, transfer and burn the Digital Content only for your personal, non-commercial, entertainment use, subject to and in accordance with the Terms of Use.
2.1.2 Upon your payment of our fees for Physical Content we grant you a non-exclusive, non-transferable, non-sub license-able, limited right to use the Physical Content for your personal, non-commercial, entertainment use, and private use only subject to and in accordance with the Terms of Use. You may copy, store, transfer and burn the Physical Content only for your personal, non-commercial, entertainment use, subject to and in accordance with the Terms of Use.
2.2 Restrictions. You represent, warrant and agree that you will use YourPianoCover service only for your personal, non-commercial, entertainment use and not for any redistribution of the Digital Content or Physical Content or other use restricted in this Section 2.2. You agree not to infringe the rights of the Digital Content’s copyright owners and the Physical Content’s copyright owners and to comply with all applicable laws in your use of the Digital Content and the Physical Content. Except as set forth in Section 2.1 above, you agree that you will not redistribute, transmit, assign, sell, broadcast, rent, share, lend, modify, adapt, edit, license or otherwise transfer, or use the Digital Content or the Physical Content. You are not granted any synchronization, public performance, promotional use, commercial sale, resale, reproduction or distribution rights for the Digital Content or the Physical Content. You may make copy on a DVD of your purchased download so long as it is only for your personal use and backup protection and you don’t change or convert the original downloads file type, content or file structure. You may only make an exact copy as outlined above.
2.3 Explicit Content. You agree that we have no liability to you for Digital Content or Physical Content you find to be offensive, indecent or objectionable.
2.4 All Sales Final; Downloading and Risk of Loss; Availability of Digital Content and Physical Content. All sales containing Digital Content are final at time of purchase. We do not accept returns of purchases containing Digital Content. Each purchase of a Permanent Download shall be deemed a final, nonrefundable sale. Prices for Permanent Downloads are subject to change without notice. You are responsible for making sure your PC or other portable devices can receive and view our Downloads. YourPianoCover is not responsible for transmission problems affecting your ability to download our files. Once you have purchased Digital Content, we encourage you to download it promptly and to make back-up copies of it. If you are unable to complete a download after having reviewed our online Download FAQ’s help section, please contact YourPianoCover customer service. You bear all risk of loss after purchase and for any loss of Digital Content you have downloaded, including any loss due to a computer or hard drive crash. We may, from time to time, remove Digital Content from the Service without notice. While we endeavor to ensure that the information on this website about each download is correct, we do not warrant the accuracy and completeness of the content on this website. We may make changes to the content on this website, or to the products and prices described in it, at any time without further notice.
2.5 Unique Identifiers. The Digital Content may include unique identifiers that are specific to you or your purchase (“Unique Identifiers”).
2.6 Authorized Devices. In order to be able to download Digital Content from YourPianoCover.com you will need to use a personal computer, smartphone or other device (”Authorized Device”) that reads .pdf-files.
2.7 License to Digital Content Downloads. Any reproduction, redistribution, transmission, sale, broadcast, public performance, sharing, rental or lending, adaptation, sub-license, modification, promotion or other use of the Permanent Downloads provided through the YourPianoCover.com, including, without limitation, any use that requires a synchronization license with respect to the underlying Digital Content, is a violation of copyright law and expressly prohibited without the prior written consent of YourPianoCover.com and our partners. Furthermore, you agree not Use the Download or Digital Content for any commercial or illegal purpose.
2.8 Represent of Use. In consideration of Your use of the YourPianoCover.com download service, You represent that You are of legal age to form a binding contract and are not a person barred from receiving services under the laws of Denmark or other applicable jurisdiction. You also represent that all information about yourself you provide to us though YourPianoCover.com Downloads Service, including, without limitation, name, address, and credit card information is true, accurate, current and complete. We reserve the right to amend and change any of our terms and conditions without notice.
2.9 Content Availability. YourPianoCover.com may, from time to time, remove Permanent Downloads from the site YourPianoCover.com. If you plan to download Digital Content that you purchase, we encourage you to do so promptly after your purchase. If you are unable to complete a download after having reviewed our online Download FAQ’s help section, please contact customer service at yourpianocover@gmail.com. Once you purchase Digital Content and we make the Digital Content available to you, you have the responsibility for completing the download within 24 hours. You assume all risk of loss of the Digital Content after downloading. In the event user loses a download from their computer they may re-download the purchased file, as long as it is still available in the time frame of 24 hours.
2.10 File Transfer & File Sharing. You must not allow copying of any sheets purchased from YourPianoCover.com including, but not limited to, copying through file sharing networks. Do not re-transmit via email. Multiple use at the same address is allowed.
3. No Reverse Engineering, De-compilation, or Dis-assembly
You may not, and you will not encourage, assist or authorize any other person to, modify, reverse engineer, de-compile or disassemble, or otherwise tamper with, the Digital Content or the Unique Identifiers, whether in whole or in part, or create any derivative works from or of the Digital Content.
4. Reservation of Rights
Except for the rights explicitly granted to you in the Terms of Use, all right, title and interest in the Service and the Digital Content are reserved and retained by the original copyright holders and publishers. YourPianoCover does not transfer any right, title or interest in the Digital Content you purchased. You do not acquire any ownership rights in the Digital Content as a result of downloading any of our Digital Content.
5. General
Termination: Amendments. If you violate any of the terms or conditions of this Agreement, your license to Purchased Digital Content will immediately terminate, and YourPianoCover.com may, in its discretion, may immediately revoke your access to the Service without notice to you and without refund of any fees. In such event, you must delete all copies of Digital Content that you have downloaded, and YourPianoCover.com shall have the right, without notice to you, to automatically discontinue your access to Digital Content from the Service. YourPianoCover.com reserves the right to suspend, or discontinue the download service, or any part thereof, at any time so long as a 90 day notice is given on the website, and YourPianoCover.com will not be liable to you should it exercise such rights, even if your use of Digital Content is impacted by this action. Our failure to insist upon or enforce your strict compliance with the Terms of Use will not constitute a waiver of any of our rights. We may amend any of the Terms of Use at our sole discretion by posting the revised terms on the Service’s website. Your continued use of the Service, the or the Digital Content after any such amendment’s effective date evidences your agreement to be bound by it.
6. Limitation of Liability
YOU EXPRESSLY UNDERSTAND AND AGREE THAT:
YOURPIANOCOVER.COM WILL NOT BE LIABLE FOR ANY INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES OR ANY KIND ARISING FROM THE USE OF THE DOWNLOAD SERVICE OR FROM PERMANENT DOWNLOADS, INFORMATION, MATERIALS OR PRODUCTS INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SERVICE, OR FOR ANY DAMAGES IN EXCESS OF THE AMOUNT PAID FOR THE SPECIFIC PERMANENT DOWNLOAD GIVING RISE TO THE APPLICABLE CLAIM FOR DAMAGES.
YOURPIANOCOVER.COM SHALL USE REASONABLE EFFORTS TO PROTECT PERSONAL INFORMATION SUBMITTED BY YOU IN CONNECTION WITH THE SERVICE, BUT YOU ACKNOWLEDGE AND AGREE THAT YOUR SUBMISSION OF ANY INFORMATION IS AT YOUR SOLE RISK, AND TO THE MAXIMUM AMOUNT PERMITTED BY LAW, YOURPIANOCOVER.COM HEREBY DISCLAIMS ANY AND ALL LIABILITY TO YOU FOR ANY LOSS OR LIABILITY RELATING TO SUCH INFORMATION IN ANY WAY.
ACKNOWLEDGMENT AND ACCEPTANCE OF THE TERMS BY PURCHASING A YOURPIANOCOVER DOWNLOAD, YOU ACKNOWLEDGE THAT YOU HAVE READ AND REVIEWED THIS AGREEMENT IN ITS ENTIRETY AND AGREE TO ALL ITS TERMS AND CONDITIONS.
